Supplements, plant extracts and phytotherapy : the sector

Launching a dietary-supplement brand almost always goes through a white-label (private-label) contract maker : a laboratory that puts a formula you brand into capsules, tablets, softgels or powders. Upstream is the plant raw material (dried plants, standardised extracts, tinctures) ; downstream, one requirement outweighs all the rest : regulatory compliance in the country where you sell. On this ground, Bulgaria brings a rare botanical resource and GMP contract makers, Romania an integrated organic phytotherapy (active ingredient grown on site), Turkey an industrial capacity to shape the forms. This document makes no health promise : a dietary supplement is a foodstuff, not a medicine, and its rules differ from one member state to another.

Bulgaria : medicinal plants and GMP contract makers

Bulgaria has one of the richest floras in Europe : more than 3,600 plant species, a large share of which is harvested and processed for herbalism and phytotherapy. The country exports on the order of 15,000 tonnes of medicinal and aromatic plants a year, of which nearly 80 % go abroad (a significant fraction to Germany). On top of this raw material sits a chain of white-label dietary supplements certified GMP : VemoHerb (Tribulus extract, integrated chain from plant to capsule), Nutrikal (contract maker with low minimum quantities, from 500 units indicative), Botanical Bulgaria (IFS-certified, more than 240 plants worked). Add a living speciality : probiotics, built on the know-how around Lactobacillus bulgaricus (LB Bulgaricum). For a "signature plant" brand or a probiotic ferment, it is serious ground. Romania : integrated organic phytotherapy and pharma softgels

Romania's strength is integrated organic phytotherapy, where the manufacturer grows its own active ingredient. The reference is Hofigal, which states it produces organically more than 80 % of its active ingredient in-house, under GMP ; alongside it, Fares (herbal teas and plants, in Orăștie) and PlantExtrakt (gemmotherapy, extracts). The country also has genuine pharma contract makers under EU-GMP : Fiterman (EU-GMP, ISO 13485), Biofarm (Romania's number one in soft capsules / softgel), Alevia and SanoVita. Turkey : industrial capacity in private label

Turkey brings forming power : units able to produce very high volumes of tablets, capsules and sachets in white label, concentrated around Istanbul and the Kocaeli basin. You find contract makers such as Samti (high volumes of white-label tablets and capsules), Nutra Formulator or Triapharma, often certified GMP, HACCP, ISO 22000 and Halal. The asset is industrial ; the limit is regulatory : Turkish supplements are not harmonised with the EU and will have to be brought into compliance with the rules of each destination member state (see below). Supplement standards : what you need before you sell

A dietary supplement is a foodstuff, not a medicine : no preventive or curative virtue may be attributed to it. Key point : supplements are not fully harmonised at EU level. Compliance is decided member state by member state. Before any sale, in France in particular :

  • manufacturing under Good Manufacturing Practices (GMP / EU-GMP), with HACCP and ideally ISO 22000, to be required from the contract maker ;
  • compliance with the "Novel Food" regulation (Reg. EU 2015/2283) : an ingredient with no significant history of consumption in the EU before 1997 must be authorised before it is placed on the market ;
  • claims that comply with Regulation (EC) No 1924/2006 : only authorised claims entered in the EU register may appear, in their exact wording ; no therapeutic claim is allowed ;
  • a national market-placement notification : in France, the notification to the DGCCRF under the transposed Directive 2002/46/EC (Téléicare procedure) before marketing.

A good Bulgarian, Romanian or Turkish contract maker will hand you its GMP/HACCP certificates and a full technical sheet (composition, dosages, specifications, allergens) ; it is up to you to handle the national notification and claim compliance in each country where you sell.

The big trap: plant lists, MOQs and fake manufacturers

The number-one trap : national botanical lists diverge from one member state to another. A plant or an extract legally authorised in Bulgaria (or Romania, or Turkey) may be banned in France, or subject to different conditions and doses. Before any import, validate the authorised-plant list of the destination country (in France, the "plants" order of 24 June 2014 and the shared BelFrIt list) and the admissibility of each ingredient : it is this check, before even the price, that decides whether you will be able to sell. Second trap : the fake manufacturer. Some well-known "local" brands are in fact produced elsewhere : Secom, for example, has its products made in Spain and Italy, not in Romania. Always ask for the factory address and the GMP certificate of the real production site. Third trap : minimum quantities, often around 500 to 1,000 units per reference (indicative, to be confirmed by quote), which vary widely by form (capsule, tablet, softgel, powder, sachet) and formula. Underlying reminder : no health benefit may be sold without an authorised claim, and Turkish supplements remain not EU-harmonised.

Can I sell in France a plant extract sourced in Bulgaria ?
Not automatically. The lists of plants authorised in dietary supplements differ from one member state to another : a plant or an extract that is legal in Bulgaria may be banned in France, or subject to different doses. Before importing, validate the authorised-plant list of the destination country (in France, the "plants" order of 24 June 2014 and the shared BelFrIt list) and the admissibility of each ingredient. That is the decisive check, before even the price.
What are GMP and the Novel Food regulation ?
GMP (Good Manufacturing Practices), with HACCP and ISO 22000, governs control of manufacturing : ask for the production site's certificate. The "Novel Food" regulation (Reg. EU 2015/2283) requires that an ingredient with no significant history of consumption in the EU before 1997 be authorised before being placed on the market. Both points are to be checked with the contract maker and on the official EU registers.
What claims can I display on a dietary supplement ?
